If any provision of these TOU is found invalid or unenforceable by a court with competent jurisdiction, that provision shall be deemed severable from these TOU and shall not affect the validity and enforceability of the remaining provisions. Failure by Company to enforce any provision of these TOU or to exercise any rights or remedies under them will not be considered a waiver of Company’s right to assert or rely on such provisions, rights, or remedies in that or any other instance. All waivers of any term of these TOU must be in writing and signed by Company.
